Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the www.chai.lv website (the "Service") operated by Chai.lv ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. General Terms

  • These Terms regulate the purchase of goods on the e-commerce platform and establish the legal relationship between the Seller and the Buyer.
  • These Terms are developed and regulated in accordance with the laws of the Republic of Latvia.
  • The Seller reserves the right to unilaterally change the Terms at any time. Changes and additions to the Terms will be available on the website. Such changes take effect on the day they are published on the website unless stated otherwise in the Terms.
  • If an order is placed before any changes to the Terms take effect, the relationship is governed by the version of the Terms that was valid at the time the Buyer made the order unless specified otherwise.
  • The Seller reserves the right to change product prices at any time in compliance with legal regulations. Buyers can rely on the prices indicated at the time of order placement; however, if prices change between placing the order and making payment, the updated prices will apply as shown in the order system.

2. Account Registration

  • Buyers can make purchases either as registered users or without registration.
  • To become a registered user, click the “Register” button on the homepage and fill in the mandatory fields. Optional fields may also be completed at the Buyer’s discretion.
  • Registered users who opt-in to receive marketing offers from Chai.lv may gain access to loyalty program benefits, including promotional offers and personalized discounts.

3. Products and Services

  • Chai.lv specializes in selling premium teas.
  • Product images on the website are for illustrative purposes only and may differ from the actual product or its packaging.
  • The product catalog, descriptions, images, and other content on the website are the intellectual property of the Seller and are protected by copyright laws. Copying or reproducing this content without permission is prohibited.
  • All products comply with legal standards for packaging and labeling.
  • Prices include applicable VAT, and delivery fees are calculated separately based on the delivery method chosen by the Buyer.

4. Orders

  • Orders are created when the Buyer adds products to the shopping cart and clicks “Proceed to Checkout.”
  • Buyers must provide accurate and complete information when placing an order. The Seller is not responsible for errors caused by incorrect information provided by the Buyer.
  • After order submission, the final total, including delivery fees, will be displayed. Payment must be made before order processing begins.
  • If an ordered product becomes unavailable after payment, the Seller will contact the Buyer to offer a substitute product or refund the payment for the unavailable item.

5. Payment

  • Buyers can select a preferred payment method during checkout and proceed with payment by clicking the “Pay” button.
  • Payment is considered complete when the Buyer receives a confirmation email indicating that the order has been accepted for processing.
  • Payment methods include MakeCommerce as a service provider for purchases. For more details, please visit MakeCommerce (link opens in a new window).
  • Payments processed via MakeCommerce are calculated in euros (€). Purchase amounts withdrawn from the Customer’s accounts are also in euros unless an alternative currency is selected for credit card transactions.
  • Accepted payment currencies and methods are clearly listed on the homepage for convenience.

6. Shipping and Delivery

  • Delivery options and fees depend on the Buyer’s selected delivery method and location.
  • The Seller is not responsible for delivery delays caused by carriers or circumstances beyond the Seller’s control.
  • Risk of loss and ownership of products transfer to the Buyer upon delivery to the carrier.
  • If delivery is unsuccessful due to the Buyer’s absence or incorrect details, the Seller is not obligated to refund delivery fees.

7. Returns and Refunds

  • Buyers have the right to return unused and undamaged products within 14 days from receipt. Specific exceptions apply to perishable goods and opened items.
  • Return requests must be submitted using the return form available on the website. Return shipping costs are borne by the Buyer.
  • Refunds are processed within 14 days of receiving the returned product and a completed return form.

8. Intellectual Property

  • Content on the website, including images, texts, and other materials, is owned by the Seller and protected under intellectual property laws. Unauthorized use or reproduction is prohibited.

9. Prohibited Activities

  • You agree not to engage in activities that disrupt the website’s functionality.
  • Misuse the Service for unlawful purposes.
  • Attempt unauthorized access to restricted areas of the platform.

10. Limitation of Liability

  • The Seller is not responsible for indirect or consequential damages arising from the use of the Service.
  • Direct liability is limited to the amount paid for the product or service in question.

11. Indemnification

  • You agree to indemnify the Seller against claims, losses, or damages resulting from your violation of these Terms.

12. Governing Law

  • These Terms are governed by the laws of the Republic of Latvia.
  • Disputes shall be resolved in Latvian courts or, in cases involving consumers, through the Consumer Rights Protection Center.

13. Changes to Terms

  • The Seller reserves the right to amend these Terms at any time. Changes take effect upon publication on the website.
  • Continued use of the Service after changes indicates acceptance of the updated Terms.
